Agency Relationships
Winhall Real Estate, Inc. Represents: Sellers and Buyers
You have the right to choose representation should you wish it. All Agency agreements must be in writing. Winhall Real Estate, Inc. Agents Fiduciary Responsibilities Include:
- Confidentiality: An agent is obligated to safeguard his principals confidences and secrets
- Loyalty: An agent is obligated to obey promptly and efficiently all lawful instructions of his principal
- Accountability: An Agent is obligated to account for all money and paper work.
- Disclosure: An agent is obligated to disclose to his principal all relevant and material information, unless obtained through a previous fiduciary relationship, that the agent knows and that pertains to the scope of the agency.
- Obedience: To Lawful instructions
A Sellers Agent:
- Works on the behalf of the Seller
- The Listing Agent, as well as the whole agency, will have fiduciary responsibility to the Seller
- When showing the Listings of another agency, we represent that Agency unless there is a Buyer Broker Agreement.
- Must disclose to potential buyers or tenants all adverse material facts about the property known by the broker.
- A separate written listing agreement is required which sets forth the duties and obligations of the parties. An agreement with a Seller takes precedence over all subsequent Buyer Agency agreements, established by Winhall Real Estate, Inc.
- Winhall Real Estate, Inc. will expose Sellers Property to all offices in the area.
- Exclusive Listings will be put on MLS and its Web site within 2 days of receipt.
- Seller pays the fee.
A Buyers Agent:
- Works on behalf of the Buyer
- Fiduciary responsibility will be given to the Buyer for all properties NOT listed with Winhall Real Estate, Inc.
- Buyers agent as well as the whole agency will have fiduciary responsibility to the Buyer.
- A separate written listing agreement is required which sets forth the duties and obligations of the parties. An agreement with a Seller takes precedence over all subsequent Buyer Agency agreements, established by Winhall Real Estate, Inc.
- It is our duty to use our expertise to help the buyer find a suitable property, acquire it at a price and on terms suitable to the Buyer. We can not make your decisions for you or take responsibility for your decisions.
- Buyers Agent will provide Source(s) of information about the property, neighborhoods etc to Buyer.
- Buyer is responsible for fee (usually paid through the transaction).
If you are a customer of Winhall Real Estate, Inc, we promise to:
- Preview properties from our office inventory as well as MLS, showing you all properties that meet your expressed needs.
- Provide factual information regarding all known material facts regarding property condition, and disclose any known defects to you.
- Prepare an offer for presentation to the Seller.
- Help you locate financing options, as well as monitor the loan process.
- Help bring the transaction to a successful close.
- Follow up after the Sale.
